These terms govern your use of ember, a mobile application developed by Sahil Hameed ("we," "us," or "our"). By downloading or using ember, you agree to these terms.
ember is a personal relationship-tending app. It helps you stay close to the people who matter most by giving you a quiet, visual space to track and nurture your connections. ember is not a messaging app, social network, or contact manager.
ember does not require an account. There is no registration, no login, and no password. All your data is stored locally on your device.
You agree to use ember for its intended purpose: personal relationship tending. You may not attempt to reverse-engineer, decompile, or extract the source code of the app. You may not use ember in any way that violates applicable laws or regulations.
ember offers optional subscriptions (ember+ monthly and annual) through Apple's App Store. Subscriptions include a 7-day free trial. All purchases are processed by Apple and are subject to Apple's terms and conditions. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your device's Settings > Apple ID > Subscriptions.
ember, its design, animations, sounds, and content are the intellectual property of Sahil Hameed. You may not copy, modify, distribute, or create derivative works based on ember without written permission.
Any content you add to ember (names, photos, notes) remains yours. We do not claim ownership over your content. Since all data is stored locally on your device, you retain full control over it at all times.
ember is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the app will be uninterrupted, error-free, or free of harmful components. We make reasonable efforts to ensure the app works as described, but we cannot guarantee perfect reliability on all devices and OS versions.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of ember. Our total liability for any claim related to ember shall not exceed the amount you paid for the app in the twelve months preceding the claim.
You can stop using ember at any time by deleting the app from your device. This removes all app data. We reserve the right to discontinue ember or any of its features at any time, though we will make reasonable efforts to provide notice.
We may update these terms from time to time. If we make material changes, we will update the "last updated" date at the top of this page. Continued use of ember after changes constitutes acceptance of the updated terms.
These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
